What we handle
- Scheduling. Coordinating a time with the buyer, seller, agents and lender, and sending the details your office uses.
- Package assembly. Lender documents as they arrive, the settlement statement, title affidavits, the information needed for 1099-S reporting, and your office's standard forms.
- Deeds and instruments. Prepared by your attorney, or filled in from your attorney-approved templates for attorney review. We don't draft legal documents on our own.
- Recording checks before signing. The items Tennessee registers look for are checked while the package is being built, not discovered at the recorder's counter (see below).
- A disbursement checklist. Every payoff, fee and proceeds line from the final statement, ready for your review.
Tennessee recording checks we build in
- Oath of consideration. For a taxable transfer, the grantee or the grantee's agent swears to the greater of the consideration or the property's value, on the deed, before the register or an officer authorized to take oaths.
- Preparer. The name and address of the person who prepared the instrument, as Tenn. Code Ann. § 66-24-115 requires.
- Acknowledgments. A notary acknowledgment for each signature, with the seal and commission expiration.
- County formatting. Some registers publish their own checklists. Hamilton County's, for example, asks for a three-inch margin at the top right of the first page so the recording stamp doesn't cover anything.
What stays with you
- Running the closing, licensed signatures and notarizing.
- Legal advice to the parties.
- Funding, wires and disbursement.
After the closing, the package moves into post-closing and e-recording.
