What we handle
- Ordering and tracking the search. We place the order with your abstractor or search vendor and follow it until the search is back.
- Pulling recorded documents you ask for. Where a county makes images available online, and where you've given us access to your subscriptions, we pull the vesting deed, prior deeds of trust, releases, plats and restrictions.
- Organizing the search package. Chain of title, open deeds of trust, releases, liens and judgments, put in the order your examiner works in.
- Writing up open questions. A missing release, a name that doesn't match from deed to deed, an estate or a trust in the chain, an entity seller. We list them for the examiner; we don't decide them.
- Keeping the exam moving. Once the exam is back, the requirements go straight into commitment drafting and the closing checklist.
What stays with you
- Title examination and every insurability decision.
- Legal opinions and anything that calls for an attorney's judgment.
- Your underwriter relationship and the final say on what gets insured.
Tennessee notes
Tennessee has 95 counties, and each Register of Deeds runs its own records. Online access is different from county to county, so how we pull documents depends on where the property is and which subscriptions you already have:
| County | Online records access (as published by the county) |
|---|---|
| Shelby (Memphis) | Many recorded documents can be viewed and copied on the Register's website at no charge. |
| Hamilton (Chattanooga) | Online database access requires an application and a $50 monthly access fee. |
| Davidson (Nashville) | A land records portal that requires signing up for an account. |
Not everything that affects title is filed with the Register. The Shelby County Register's own FAQ notes that some liens are filed with the courts, which is why the search package needs more than a deed-book pull.
